How to start a business, Business Attorney #IntentionallyDifferent

Five Steps to start a business

Based on the most recent data available business start-ups are still slumping since the Great Recession. Start-ups have continued to decline (only 414,000 were formed in 2015  (a slight increase from 2014) based the most recent Census Bureau figures. To give some perspective – before the recession, there were 558,000 companies formed in 2006.

The good news? Washington State has seen some of the highest statistical business creation rates as the economy continues its rebound. If you are looking to test the waters with your business idea we recommend following these ten steps to ensure that your new business will be one of the 49% of businesses that survive five years or longer.

Step One – Market Research

Starting a business without first doing your research can be like driving from Seattle to Miami without a map or street signs. If you conduct market(ing) research, you will be able to use the results of your research to create a business plan and marketing plan (or measure the likely success of your current plans). You should find out some answers to the following questions:

  1. Is anyone else doing this idea (or something similar)? If not, are there any good reasons why not? If so, how would your idea be different?
  2. Who are your potential clients/customers/vendors?
  3. How do you market to your potential clients/customers? (How do your customers choose you over a potential competitor?)

Step Two – Write a Business Plan

So – just like it’s not a great idea to drive from Seattle to Miami without a map or signs… you also shouldn’t start your business without a thought-out business plan. A business plan is a living breathing document – as such, we recommend taking a look at these service providers that provide a step-by-step approach and will help you create a business plan that you can continue to track as you grow:

  1. Live Plan
  2. Business Plan Pro
  3. Monday.com

“If you fail to plan, you are planning to fail!” – Benjamin Franklin

Step Three – Get Opinions

Feedback, in any form, helps us formulate a plan to cultivate the success we are chasing. In that regard, you should formulate a strategy that allows people to interact with you, your company, and your product or service.

Unbiased feedback will help you focus on areas to improve as well as growth areas. Check out the video below for some tips on how to get feedback.

HANDLING FEEDBACK REMINDER:

  1. Lead with your appreciation. Saying ‘thank you’ will establish that you and your company are grateful for any feedback – even the negative feedback and that you view it as an opportunity to grow.
  2. Find the truth behind the feedback. Not all feedback is going to be effective, or even true. With that, we recommend finding the truth behind the communication and ignoring any comment or request that falls outside of your established strategies or products.
  3. Look for the patterns. Are you receiving a ton of positive feedback about a specific concept, service or product? Chances are your strategies are likely working well in that area. Finding patterns in your feedback (both positive and negative) will help guide your focus.
  4. Ask questions. Engaging your audience by asking questions will help you learn specifically what someone did or did not like and how you can improve.

Step Four – Get in the Game

  • You will need to choose a business structure. (Will you be a corporation, limited liability company, partnership, or another type of legal structure?)
  • You will need to choose a name for your business/brand.
  • You will need to register your business (including obtaining state and federal identification numbers as well as any permits and/or licensing necessary to conduct your specific type of business.
  • You will also want to ensure that your new business idea and brand are protected. Adequate insurance protection is a given, but you will also want contracts/agreements between you and any other business partners, your customers and any other vendors. You may also want to look into costs associated with Trademarking, copyrighting or perhaps even obtaining patents to ensure you are protecting your business from competitors.

Step Five – Grow

Continued growth will depend on your efforts to continually invest in superior customer service, hiring great team members, creating a superior product or providing superior services, and then continue to learn as you grow.

What Do I do if I have been in an auto accident?

The moments following your accident will be stressful. Follow these Car Accident Help Steps:

1. Find a safe place to stop. Check for injuries.

Find a safe place to stop your car and check yourself and other passengers in your vehicle for injuries or other health and safety concerns. If you have suffered any type of injury because of the negligence of another car you should immediately (or as soon as practicable) seek medical attention for diagnostic evaluation and potential treatment or have someone else contact authorities.

Seeking immediate medical attention not only increases your chance of a positive prognosis but also works to create a medical record with diagnostic evidence that helps build your claim.

NOTE: STAY AT THE SCENE OF THE ACCIDENT UNTIL IT IS APPROPRIATE TO LEAVE. Leaving the scene of an accident where someone has sustained injuries can subject you to serious criminal penalties.

2. Call Law Enforcement

If there is a significant amount of property damage, physical injury, or death – call the police or local law agency.

3. Exchange Information

You will want to get the following information: (a) Name(s), (b) address(es), (c) drivers’ license number(s), (d) license plate numbers, (e) basic insurance information (policy number, etc.) of all drivers involved, and (f) if there are passengers, obtain their names, numbers, and addresses.

Be cordial. Be cooperative.

NOTE: You should never apologize for anything at the scene. (Example: “I’m so sorry, I blew through that stop sign!”) – this is an admission of liability. Immediately following an accident it isn’t necessarily clear who is at fault.

4. Talk to Witnesses

Ask every witness to the accident what he or she may have seen. Obtain names, numbers, addresses and email addresses, if possible.

5. Take Pictures. Take Pictures. Take Pictures.

Photos of damage to all vehicles (including the amount of the damage, weather conditions, location and any other factors that you think are relevant) should be taken by you or someone who has the ability to take photographs. These may positively impact your claim later.

6. Inform Your Insurance Company

Promptly tell your insurance carrier you have been involved in a car accident. You should cooperate with them and tell them the truth about what happened and the extent of your injuries.

7. Contact an Attorney Prior to Speaking to an Insurance Company

What is Personal Injury Protection? – Experienced Personal Injury Firm #IntentionallyDifferent

Personal Injury Protection – PIP?

PIP stands for personal injury protection (personal injury protection), and it is an extension of car insurance that covers medical expenses and, in many cases, lost wages, loss of services, and funeral costs. It is often called “no-fault” coverage because its inherent comprehensiveness pays out claims agnostic of who is at fault in the accident.

Am I required to have PIP?

In Washington, Insurance Companies are required to offer PIP coverage, but you are not required to accept it. If you do not wish to have PIP coverage, however, you must reject the coverage by your signature.

While you have the ability to opt out of your PIP coverage, we highly recommend obtaining PIP coverage to protect you in the event you are unprotected – for any reason whatsoever.

I have PIP, but who does it cover?

In Washington, PIP will cover:

  • The individual named on the policy;
  • All household residents related by blood, marriage or adoption;
  • Step-children and Foster-children;
  • Any other non-family passengers (and pedestrians) involved in an accident.

Is there anything PIP doesn’t cover?

PIP typically does not cover injuries caused by using motorcycles (PIP coverage is available for motorcycles, but is usually very expensive), recreational or off-road vehicles, mopeds, or farm equipment.

PIP will not cover intentional injuries caused by the insured, the insured person if the injuries were caused due to organized racing activity, or an insured person while committing a felony.

PIP also will not cover any services that the insurance company deems unreasonable, unnecessary, related to the accident, or outside three years from the date of the accident.

Do you still have questions about PIP coverage?

Evergreen has reviewed countless insurance claims and policies. We recommend PIP coverage to all of our clients, friends, family, and neighbors. It’s typically a few additional dollars per month. Call us today at 253-693-2244 in Puyallup-Tacoma or 425-697-9255 in Everett/Lynnwood.
