Custody

Many people use the term “custody” to talk about time they are able to spend with their children. However, parenting plans in Washington do not use “custody” to refer to this time. Instead, the parenting plans use residential schedules and decision making to indicate what each parent’s rights are with respect to time with their children and decisions made for them.

Although a custodial parent is designated in Washington parenting plans (for purposes of greater state and federal statutes requiring such a designation), this does not decide “custody” as it’s concerned with actual time spent with the children. Often, we have parents who are concerned about custody, but find out they are really concerned with residential time.

Each family is unique with respect to what residential schedule is in the best interest’s of the children. If you want to know more about common residential schedules, and what may be the best fit your family, give us a call today and find out what makes us #intentionallydifferent.

Child Support

Most parents want to provide for their children. Child Support obligations are calculated by a statutory formula. If you would like to estimate the child support obligations specific to your circumstances visit the Washington State Child Support Calculator provided by the Washington Department of Social and Health Services (WA DSHS).

The question as to whether you will be receiving or paying child support in today’s uncertain economy brings its own concerns and yes, anxieties. Evergreen Law Office can help you whether you need to establish a child support order, enforce one, or if you have been served with a child support action. We also assist with enforcing out-of-state support judgments.

There are many factors that are a basis for a petition to modify a child support obligation, and Evergreen Law Office can also assist you if you are seeking a Modification to an existing order.

There are many ways to protect your wishes in the event that you cannot articulate these wishes later in life. However, even with a plan in place, it is possible for people to find their loved ones in need of an advocate. Perhaps the person who was supposed to speak on your loved one’s behalf can no longer do so, or maybe the plan your loved one put in place is no longer valid for some reason. Often, places such as care facilities or banks require decisions to be made for an individual, but simply being related to the individual is not enough to give you the ability to make those decisions. If you have a loved one that no longer has the capacity to make his or her own decisions, and needs someone to make these decisions, a guardianship may be the answer.

Guardianships can also help protect minor children (for example, a young child who inherits money and needs someone to manage that money) or adults with disabilities (for example, those who are technically old enough to be considered an adult, but who still need some help navigating decisions into young adulthood).

Guardianship is initiated through the courts and may be “of the person,” “of the estate,” or both. A guardianship “of the person” gives the guardian the ability to act and make decisions related to the individual (medical decisions, social decisions, etc.). A guardianship “of the estate” gives the guardian the ability to act and make decisions related to the individual’s finances. Many times, a guardian will be both of the person and of the estate. The guardian does not necessarily need to be a family member or close friend; in fact, there are professional guardians who may be able to step in to serve as guardian for your loved one.

How do I prepare for my divorce?

Divorce is life changing. If you or a loved one is thinking about moving forward with the next chapter of life by filing for a divorce in Washington you should consider taking these next steps in order to prepare you for the journey.

“Divorce isn’t such a tragedy. A tragedy’s staying in an unhappy marriage, teaching your children the wrong things about love. Nobody ever died of divorce.” Jennifer Weiner, Fly Away Home

Get Organized

There will be multitudes of significant decisions during the divorce process. Simply put, the more organized you are – the more prepared you will be to make many of those decisions…especially if you have minor children.

You should try to prepare financially for the divorce itself (like court fees, legal fees, moving fees, etc.).  You should also start preparing for the reality of living in separate households. We recommend creating both a marital budget to better understand current monthly expenses living jointly as well as a separate household budget so that you can plan and balance as necessary.

We also recommend obtaining copies of the following important documents:

  • SSNs and Drivers license numbers;
  • Pay stubs (preferably at least 6 months worth);
  • W2s & most recent federal and state tax returns;
  • Bank account statements and account numbers;
  • Credit card statements and account numbers;
  • Retirement account statements and account numbers;
  • Brokerage account statements and account numbers;
  • Insurance policies and account numbers (health, property, etc.);
  • Mortgage statements;
  • Car loan statements and account numbers;
  • List of assets (Vehicles and VINs, Real Property, other types of personal property) – it is also wise to get a professional evaluation of value on major assets;
  • List of debts (including names and numbers of all accounts, holders, and current statement or balance).

Get Support, Build Community, & Stay Healthy

Your mental health is very important, and navigating the turbulent waters of divorce will be very difficult work at times. If you have minor children, their mental health will also be impacted by this very stressful transition.

The divorce process will also take a toll on your physical health. Many people experience insomnia, weakened immune systems, and weight gain.

We highly recommend you find mental health support for yourself and any minor children as well as find a path to healthy eating, sleeping and working out patterns to start your next chapter in a life that is #IntentionallyDifferent.

  • The different types of separate property and how much you each brought into the marriage or domestic partnership;
  • The length of your marriage;
  • The current income of the parties as well as the income potential of the parties;
